1. DEFINITIONS

The following terms are used in these General Terms and Conditions.

1.1 UTCA TATTOOS: the general partnership Utca's Finest V.O.F. established in Utrecht at Vinkenburgstraat 8a, as well as all its branches 1.2 Client: the natural person who issues an order to UTCA TATTOOS to have a tattoo or piercing applied, as well as who is treated by UTCA TATTOOS or to whom UTCA TATTOOS products or provide services. 1.3 Agreement: any agreement between UTCA TATTOOS and the Client for the delivery of products or services, including the application of a tattoo, piercing or other cosmetic treatment.

2. APPLICABILITY

2.1 These General Terms and Conditions apply to all agreements between UTCA TATTOOS and the Client, whereby UTCA TATTOOS acts as a (potential) seller and/or supplier of products and/or services. These General Terms and Conditions can only be deviated from in writing and with the express consent of UTCA TATTOOS.

2.2 All deliveries of products and/or services by UTCA TATTOOS are provided without exception by UTCA TATTOOS and never by the individual acting persons engaged by or on behalf of UTCA TATTOOS.

2.3 The Client who enters into an Agreement with UTCA TATTOOS expressly agrees to these General Terms and Conditions used by UTCA TATTOOS.

3. OWN RESPONSIBILITY AND OWN RISK

3.1 All assignments from the Client to UTCA TATTOOS are provided under the Client's own responsibility and at the Client's own risk.

3.2 By ordering UTCA TATTOOS to apply a tattoo, piercing or other cosmetic treatment, the Client declares to be aware of all possible consequences of the treatment, including medical, psychological and social consequences. The Client is aware that the body decorations applied by or on behalf of UTCA TATTOOS can never be removed completely or in a cosmetically attractive manner.

3.3 By ordering UTCA TATTOOS to apply a tattoo, piercing or other cosmetic treatment, the Client also declares that he/she is in good health, does not suffer from any form of allergy, haemophilia, diabetes, immune disorder, skin condition or otherwise. and is not infected with any blood-borne diseases (such as HIV, hepatitis A, B or C or otherwise) and that his/her treatment would not otherwise endanger the health of UTCA TATTOOS employees or third parties in any way.

3.4 The Client guarantees that he/she is 18 years of age or older and that he/she has made a well-considered decision to have a tattoo or piercing applied by UTCA TATTOOS.

3.5 In the event that the person who wishes to be treated by UTCA TATTOOS is between the ages of 12 and 18, the treatment/delivery by UTCA TATTOOS will only take place with written permission and in the presence of his parent or guardian. In that case, the parent/guardian counts as the Client. This only applies to piercings. UTCA TATTOOS does not tattoo anyone under the age of 18, even with parental/guardian permission.

3.6 UTCA TATTOOS does not treat children under the age of 12, not even with parental/guardian consent.

3.7 UTCA TATTOOS always has the right to ask the Client to show a valid proof of identity, to make copies and keep it. If the Client does not show a valid proof of identity, UTCA TATTOOS has the right to refuse the Assignment.

4. LIABILITY

4.1 By ordering UTCA TATTOOS, the Client acknowledges that UTCA TATTOOS has a best efforts obligation. UTCA TATTOOS will use its best efforts to achieve the intended result. UTCA TATTOOS can never guarantee that the intended result will actually be achieved. UTCA TATTOOS is not liable for the failure to achieve or not fully achieve the intended result, nor for damage that could arise as a result of a treatment, unless it is established that the damage is due to its intent or gross negligence.

4.2 In the event that UTCA TATTOOS is found liable for any damage suffered by the Client, the compensation will be limited to the amount charged by UTCA TATTOOS to the Client for the relevant delivery of products or services.

4.3 Any right to compensation shall in any case lapse insofar as the Client has not taken measures immediately after the occurrence of the damage to limit the damage or to prevent more or other damage, and has not informed UTCA TATTOOS in this regard as soon as reasonably possible. provided with all relevant information.

4.4 UTCA TATTOOS stipulates all legal and contractual defenses, which it can invoke to fend off its own liability towards the Client, also on behalf of its employees and any third parties for whose conduct it would be liable under the law.

5. WARRANTY

UTCA TATTOOS only uses colors/dyes for tattooing that have been checked and supervised by the Ministry of Health, Welfare and Sport and the Inspection Service for Commodities, as determined in the Commodities Act Decree on Tattoo Dyes.

6. APPLICABLE LAW/COMPETENT COURT

6.1 Dutch law applies to these General Terms and Conditions, as well as to all agreements to which the General Terms and Conditions apply or also apply.

6.2 Disputes between UTCA TATTOOS and the Client, arising from the agreements to which the general terms and conditions apply or also apply, will be adjudicated exclusively by the competent court of the District Court in Utrecht, unless UTCA TATTOOS expressly chooses as the claimant or requesting party. before the competent court of the Client's domicile or place of business.

7. CONVERSION

If and insofar as on the grounds of reasonableness and fairness or the unreasonably onerous nature any provision in these general terms and conditions cannot be invoked, the meaning and scope of that provision shall be as similar as possible, so that an appeal can be made to it. be done.

7. REFUNDS

There is no such thing as refunds on tattoos, when considering a tattoo at UTCA TATTOOS, you sign our consent forms wich you agree on all the above terms and such. Before tattooing you always get to see your stencil applied, in real, in the mirror and digital. Getting tattooed is always on your own risk and artists are not responsible for your tattoos the moment you leave our door. 9. FINAL PROVISION

These General Terms and Conditions are also stipulated for all employees of UTCA TATTOOS and third parties engaged by it for the execution of the Agreement. This stipulation can never be understood as any acknowledgment that the said employees or third parties engaged have acted in a personal capacity for the execution of the Agreement.
